1. Definitions

The terms used in the Regulations shall mean:

Customer - a natural person, legal person or an organizational unit that is not a legal person, to which
       special regulations grant legal capacity, who places an Order in the Store;
Consumer - a customer who is a natural person and meets the criteria specified in the definition of Article 22[1] of the Civil Code. According to this definition, a Consumer is a natural person making a legal transaction with an entrepreneur which is not directly related to with his economic or professional activity.
Civil Code - the law of April 23 1964 (Journal of Laws No. 16, item 93 as amended);
Terms and Conditions - these Regulations for the provision of electronic services within the framework of the Healing Shilajit online store;
Online Store (Store) - the Internet service available at www.healingshilajit.pl, through which the Customer may, in particular, place Orders;
Merchandise - products presented in the Online Store;
Contract of Sale - a contract of sale of Goods within the meaning of the Civil Code, concluded between Himalayan Healing Private Limited Spółka z o.o. and the Customer, concluded using the Internet service of the Store;
Consumer Rights Act - the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2014, item 827);
Act on Provision of Electronic Services - the Act of July 18, 2002 on Provision of Electronic Services (Journal of Laws No. 144, Item 1204, as amended);

Order - a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

2. General provisions
(1) These Regulations set out the rules for the use of the online store available at: www.healingshilajit.pl and are the rules referred to in Article 8 of the Act on Provision of Electronic Services.
(2) The online store, operating at: www.healingshilajit.pl, is operated by Himalayan Healing Private Limited Spółka z o.o., ul. Małachowskiego 8/P1, 61-129 Poznań, NIP No. 7822914008, KRS 0000991701.
(3) These Regulations define in particular:

1. rules for registration and use of an account within the online store;

2. terms and conditions for making electronic reservations of products available within the online store;
3. terms and conditions for placing Electronic Orders within the online store;
4. the principles of concluding Sales Contracts using the services provided by the online store.

(4) The use of the online store is possible provided that the ICT system used by the Customer provides:

1. an up-to-date web browser that provides stable support for standard, commonly used web technologies and protocols, including: html, http, UTF-8 character encoding, .jpg image format, support for forms, buttons, encrypted connections.
2. a display with a resolution at least compatible with the resolution of the page, or software that provides the user with scrolling capabilities.
3. Internet connection to ensure continuous data transfer.

(5) In accordance with applicable laws and regulations, Himalayan Healing Private Limited Company Ltd. reserves the right to limit the provision of services through the Online Store to persons who are at least 18 years of age. In such case, potential Customers will be notified of the above.
(6) Customers may access these Terms and Conditions at any time through the link provided on the home page of www.healingshilajit.pl and save their content and make a printout.

3. Rules of use of the Online Store

(1) In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store shall take technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted over the Internet.

(2) The customer shall:

1. not to provide or transmit content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,
2. to use the online store in a manner that does not interfere with its operation, in particular by using certain software or devices,

3. use of the online store in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of Internet use.

4. Procedure for concluding a Sales Contract

(1) Information about the Goods given on the Store's websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.

(2) In order to conclude a Sales Agreement through the Online Store, you must go to the website www.healingshilajit.pl, make a selection of goods, taking further technical steps based on the messages displayed to the Customer and the information available on the website.

(3) The selection of the Goods ordered by the Customer is made by adding them to the shopping cart.
(4) In the course of placing the Order - until the Customer clicks the order confirmation button - the Customer has the possibility to modify the entered data and the selected Goods. In order to do so, it is necessary to follow the messages displayed to the Customer and the information available on the site.
(5) After the Customer using the online store has provided all the necessary data, a summary of the placed order will be displayed. The order summary will contain information regarding:

1. the subject of the order,
2. the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
3. the selected method of payment,

4. the selected method of delivery

(6) In order to send the Order it is necessary to provide personal data marked as mandatory and press the button confirming the order.
(7) sending of the Order by the Customer constitutes a statement of intent to conclude with Himalayan Healing Private Limited Company Ltd. Sales Agreement, in accordance with the content of the Regulations.
(8) After submitting the Order, the Customer shall receive a confirmation of all essential elements of the Order.
(9) The Contract shall be considered concluded from the moment the Customer receives the confirmation referred to above.
(10) the data of the Order and the general terms and conditions (Terms and Conditions of the online store) are recorded, secured and made available by e-mail.

5. Delivery

1. The store usually ships ordered products, fresh, from its manufacturing location in Pakistan using national postal carriers
2. some orders may be shipped from other locations to improve logistics efficiency
3. The store offers shipping to all countries of the world, but some areas may be temporarily unavailable due to carrier restrictions
4. the store reserves the right to cancel orders if shipping services are unavailable. Payments for cancelled orders are immediately refunded in full to the customer.
5. The store provides tracking numbers for all orders shipped. The availability of tracking service may be limited by some carriers

6. The store declares an approximate estimated delivery time within 4 weeks of purchase. Actual delivery time may vary depending on destination and shipping considerations.

7. Customers are responsible for:

(a) providing an accurate delivery address when placing an order
b) completing any import procedures if required by the laws of the destination country. This may include payment of customs duties or taxes.
(c) accepting delivery. Depending on the carrier's policy, this may sometimes require you to pick up the shipment at a post office or other pickup point, or receive a phone call from the carrier.

8. Refunds of payments for orders returned by carriers as unclaimed, rejected, undeliverable, or for any other reason attributable to the customer, may be reduced by the cost of shipping and return shipping.
9. The ability to change the delivery address after the order has been shipped depends on the carrier's policy. In most cases, it may not be available or may incur an additional fee. We recommend that you set the delivery address where the shipment can be picked up at any time within two months of placing the order.

6. Prices and payment methods

(1) The prices of the Goods are given in Polish zloty or another selected currency and include all components, including VAT.

(2) The customer has the option to pay the price:

1. by bank transfer to the Store's bank account number,
2. payment via electronic payment systems made available on the site,
3. by Visa, Maestro/MasterCard payment card. The instruction to charge the payment card is made at the time of order confirmation.

4. in cash, when picking up the order at a stationary point of sale

7. Right to withdraw from the contract

(1) The customer who is a Consumer has a 14-day period to withdraw from the contract. A consumer has the right to withdraw from this contract within 14 days without giving any reason. The term to withdraw from the contract expires after 14 days from the day on which you took possession of the item or on which a third party other than the carrier and indicated by you took possession of the item.

(2) In order to exercise your right of withdrawal, you must inform us via the relevant link on the website, or in an e-mail to himalayanhealingeurope@gmail.com sent from the address used to place the order, of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).
(3) In order to comply with the withdrawal period, it is sufficient for you to send information on the exercise of your right of withdrawal before the expiry of the withdrawal period.

8. Consequences of withdrawal

(1) In the event of withdrawal from the contract, we will return to you all payments received from you, including the costs of delivery of the goods (except for the additional costs resulting from the delivery method chosen by you other than the cheapest ordinary delivery method offered by us), immediately and in any case no later than 14 days from the day on which we are informed of your decision to exercise your right of withdrawal from this contract. We will refund the payment using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with the refund.
(2) We may withhold reimbursement until we receive the item or until you provide us with proof of return, whichever event occurs first.

(3) We will pick up the item, and if we are unable to provide pick-up, we will provide the necessary data to return the item within 14 days. We will collect the item at our expense. You are liable only for the diminution in the value of the thing resulting from the use of the thing in a manner other than necessary to determine the nature, characteristics and functioning of the thing.

9. Complaints about the Goods
(1) Himalayan Healing Private Limited Spółka z o.o., as a seller, shall be liable to the Customer who is a Consumer within the meaning of Article 22[1] of the Civil Code, under warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Articles 556[1] - 556[3] et seq. of the Civil Code.
(2) Complaints arising from violation of rights guaranteed by law, or under these Regulations, should be addressed to himalayanhealingeurope@gmail.com The Seller undertakes to consider each complaint within 14 days.

10. Complaints about the provision of electronic services
(1) Irregularities related to the functioning of the service and the store's websites, the customer may report in writing to the address: himalayanhealingeurope@gmail.com or using the contact form.

(2) In a complaint, the customer should describe the type and date of occurrence of irregularities related to the operation of the Store.
11. Dispute resolution and final provisions.
(1) In case of any objections to the product received or the quality of service, Customers are advised to contact the Store in the first place. The store undertakes to evaluate the request individually and propose a solution that will compensate for the inconvenience caused in the best possible way.
(2) The information provided on the site may not be exhaustive, or may be understood by the Customer contrary to the intention of the Seller. In case of any doubts and questions, we recommend contacting the Store using the contact information provided on the site.
(3) In case of not receiving a response from the Store to an inquiry within 7 days, the Customer is recommended to make a repeated attempt to contact using another means of communication.

(4) The customer, who is a Consumer, may, if interested, use out-of-court ways of dealing with complaints and claims. Disputes regarding online shopping can be resolved through mediation proceedings before the Provincial Inspectorates of Trade Inspection or a trial before an arbitration court at the Provincial Inspectorate of Trade Inspection. Consumers can also use other methods of out-of-court dispute resolution and, for example, submit their complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
(5) In matters not covered by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on Provision of Electronic Services and other relevant provisions of Polish law shall apply.
